These terms govern your use of the Bingether app. By creating an account, you accept them. They are short because the app is simple: it exists so the people in your household know how far along each of you is in the shows you watch.
This agreement is between you and PLIXEN, a SASU with share capital of 300 euros, registered office at 14 rue Bausset, 75015 Paris, France, registered with the Paris Trade and Companies Register under number 981 321 342. It is not an agreement with Apple, nor with Google.
The French version of these terms is the binding one. This translation is provided for convenience.
1. Your account#
Bingether has no passwords. You enter your email address, you get a link, you tap it: you are signed in. This means access to your inbox is access to your account. Protect it accordingly.
An account is personal. You are responsible for what happens on it.
Bingether is not intended for people under fifteen.
2. The household#
A household holds two to six people. It is private and invitation-only: you join only with a link sent by a member, and that link expires after fourteen days.
Members of a household see, of one another: display name, colour, the shows and films they follow, and how far along they are in each. That is what the product does, not a side effect. If you do not want something seen by your household, do not track it from this account.
Whoever creates a household owns it. If they leave or delete their account, ownership passes to the longest-standing member and the household carries on for everyone else. A household whose last member leaves is gone.
You can leave a household at any time. What you take with you is your own tracking; what you leave behind are the viewings you recorded for others.
3. What Bingether is not#
It is not a social network. There are no public profiles, no followers, no people search, no feed. Nothing you watch is visible outside your household.
It is not a streaming service. Bingether plays no episodes and hosts no video. It notes what you watched elsewhere.
4. The catalogue#
Titles, artwork, summaries and air dates come from TheTVDB. They belong to their respective rights holders, and we display them under our licence with TheTVDB.
This information can be incomplete or wrong: a release date moves, a localised title arrives late, a season is split oddly. We fix what we can, and we do not warrant the accuracy of the catalogue.
5. The free tier#
Free is permanent, not a trial. Creating a household, inviting a second person and following three shows together stays possible indefinitely without paying.
On the free tier, a household holds two people and can follow three ongoing shows watched together. Films are never counted. Shows each of you follows separately are not counted either: only deliberate shared tracking is.
Exporting all your data is free and will stay free. That is a commitment, and it will never sit behind a payment.
6. The paid tier#
This section takes effect when purchases open. While no offer is presented in the app, it does not apply.
The paid tier takes a household up to six people, lifts the counter on shows watched together, and unlocks viewing groups and the household summary.
The entitlement is attached to the household: one member holding it is enough for the whole household to benefit. Paying twice for the same household achieves nothing, and the app tells you so.
One subscription unlocks at most three households over a rolling twelve months. This is an anti-abuse limit, and it applies to the unlocking, never to membership: you may join as many households as you like, and you always get in. Beyond the third, the household you join simply follows the free tier rules, unless someone else there is subscribed.
The three households counted are the first three of the window, not the last three: joining a fourth takes nothing away from the one you have had for eleven months. A place frees up as soon as the oldest of the three leaves the twelve month window, and the app tells you the date at the moment you meet the limit.
Households created before purchases opened keep the paid tier for life, with no condition and no expiry. That entitlement belongs to the household, not to its members: it is not lost when the membership changes.
Reaching a limit breaks nothing and erases nothing. What is under way stays; it is adding a new shared show, or a new member, that is refused, with the reason explained.
7. The purchase, and who sells it to you#
On iOS the subscription is sold by Apple; on Android, by Google. They take the payment, they invoice, they apply VAT and they issue refunds. We never see your payment method.
What that means in practice:
- Cancellation happens on their side, in the subscription settings of your App Store or Play Store account. We cannot cancel for you.
- Refunds are theirs to grant. If you want one, ask them; we can neither grant nor refuse it.
- A subscription renews automatically until cancelled, on the terms shown at the time of purchase.
- The price is the one shown in the app at the time of purchase, in your currency.
8. Deleting your account#
You can delete your account at any time, from Settings. Deletion is immediate and permanent. Export your data first.
Deleting your account does not cancel your subscription. These are two separate things, handled by two different parties. Until you cancel with Apple or Google, the charge continues.
If you bought lifetime access and delete your account, that purchase becomes claimable again: you will be able to restore it on a new account.
9. What you agree not to do#
By using Bingether, you agree not to:
- work around free-tier limits by technical means;
- create accounts in bulk to multiply households;
- scrape the catalogue;
- use a display name that is abusive, or that impersonates someone;
- attempt to reach the data of a household you are not a member of;
- and more generally, use the app in a way that breaks the law or infringes someone else's rights.
If you breach one of these undertakings, we will tell you and ask you to put it right. We will only suspend or close your account if it is not corrected within fifteen days of that notice. Suspension is immediate, with notice following, in the single case where the breach is causing ongoing harm to another person or to the service.
10. Availability and liability#
Bingether is provided as is. We use reasonable efforts to keep it available, without warranting continuous availability: the service may be interrupted for maintenance, or by a provider's failure.
We are not liable for indirect damages. Nothing in these terms excludes the statutory warranties of conformity and against hidden defects, nor liability for gross negligence or personal injury.
If the service were to shut down, we would give you reasonable notice and export would remain available to the end.
11. Changes#
We may update these terms. The date at the top says when.
Any change that reduces your rights, increases your obligations or changes the price will be announced in the app at least thirty days before it takes effect. You can refuse it by deleting your account before that date. Other changes, such as correcting a mistake or clarifying wording, take effect when published.
12. Apple App Store provisions#
This section applies only to the version installed from the App Store. It exists because Apple requires it, and it prevails over the rest of this text where they conflict on these specific points.
- These terms are entered into between you and us only, not with Apple.
- Apple is not responsible for the app or its content.
- The licence granted to you is non-transferable and limited to use of the app on Apple-branded devices that you own or control, as permitted by the Usage Rules of the App Store terms of service.
- Apple has no obligation whatsoever to furnish maintenance or support for the app.
- In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever, and any other claims are our responsibility.
- We are solely responsible for claims relating to the app: product liability, failure to conform to a legal or regulatory requirement, and claims under consumer protection law.
- If a third party claims the app infringes its intellectual property rights, we are solely responsible for the defence and settlement of that claim.
- You represent that you are not located in a country subject to a US Government embargo or designated by the US Government as a terrorist-supporting country, and that you are not listed on any US Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms and have the right to enforce them against you.
13. Governing law#
These terms are governed by French law. If you are a consumer, you keep the benefit of the mandatory provisions of the country where you live.
If something goes wrong, write to us first at contact@bingether.app. Most things get settled there. If the disagreement is about a payment, take it to Apple or Google, who take the money and issue refunds.
None of the above stops you from going to court. If you live in another European Union country, the European Commission publishes the list of dispute resolution bodies at consumer-redress.ec.europa.eu.
14. Language#
The French version of these terms is the binding one. Translations are provided for ease of reading.
